Firozabad MLA Rambir Singh has got a big blow from Allahabad High Court. The court has transferred the hearing of the criminal conspiracy case against him, including murder, assault, going on in the Firozabad MPMLA court, to the Agra MPMLA court. Along with this, the prosecution has been ordered to inspect more witnesses. Justice Dinesh Kumar Singh has given this order while simultaneously hearing two petitions of Rampal Singh.
The petitioner sought quashing of the entire proceedings of the Firozabad Special Court MPMLA Court under Section 482 of the CrPC and transfer of the trial to a competent special court in another district. The petitioner had lodged an FIR under sections 147, 149, 302, 307 and 120B of the IPC at Jasrana police station in Firozabad against five people including the MLA.
After deliberation, the MPMLA court sentenced 10-10 years against four people under section 304 of IPC. The prosecution could produce only four witnesses in the case. It was said on behalf of the petitioner that the respondent MLA does not want to complete the hearing soon. Along with this, the testimony of other witnesses is also not being allowed. Transferring the case to Agra MPMLA Court, the Court has ordered the petitioner’s application and summoning of witnesses to be inspected. Additional Advocate General MC Chaturvedi and Additional Government Advocate Sanjay Singh presented the side on behalf of the government.
